Montgomery County lies roughly 60 miles north of Galveston Bay and is outside the Texas Coastal Management Program (CMP) jurisdiction — the General Land Office does not regulate development here. Instead, waterfront development around Lake Conroe, Lake Creek, Spring Creek, and the West Fork San Jacinto River is governed by: San Jacinto River Authority dam operations, FEMA NFIP floodplain standards (Montgomery County Floodplain Regulations), and TCEQ water quality protections. Lake Conroe has a published 201-foot elevation normal pool — structures below 207 ft (100-yr flood elev) face elevation requirements post-Harvey. Bulkhead and pier permits issued by SJRA and USACE under Nationwide Permit 3 for maintenance of existing structures; new construction over navigable waters requires Section 404 Clean Water Act review. TX Natural Resources Code Ch. 33 coastal rules do not apply.
