Coastal development in Suffolk County is heavily regulated due to Boston Harbor, Chelsea Creek, Belle Isle Marsh, and the Revere/Winthrop beaches. Three regulatory tiers apply: (1) Chapter 91 Waterways License from MassDEP (310 CMR 9.00) is required for any structure, fill, or dredging in tidelands or navigable waters β piers, seawalls, revetments, or even docks need a license. (2) Wetlands Protection Act jurisdiction (MGL c. 131, Β§40 and 310 CMR 10.00) covers all work within 100 feet of coastal banks, dunes, salt marshes, land subject to coastal storm flowage, or within 200 feet of perennial streams β requires a Notice of Intent to the Conservation Commission and Order of Conditions. (3) Local zoning overlays β Boston Zoning Code Article 25A (Coastal Flood Resilience Overlay District, adopted 2021) requires elevation of the lowest occupied floor to BFE + 2 feet and flood-resistant construction in AE and VE zones. Revere Zoning Ordinance Β§17.28 (Floodplain District) and Winthrop Zoning Bylaw Β§17.15 adopt equivalent requirements referencing 780 CMR. Chelsea Zoning Β§34-260 addresses the Mill Creek area. All projects in mapped Velocity Zones (V-Zones) must use pile or column foundations, breakaway walls, and meet ASCE 24 requirements. Sea level rise planning under MA CZM's Resilient Massachusetts Action Team (RMAT) standards now applies to state-funded projects.
