Montgomery County lies roughly 60 miles north of Galveston Bay and is outside the Texas Coastal Management Program (CMP) jurisdiction β the General Land Office does not regulate development here. No coastal setbacks, beach access easements, or dune protection rules apply. Instead, waterfront development around Lake Conroe, Lake Creek, Spring Creek, and the West Fork San Jacinto River is governed by: San Jacinto River Authority dam operations, FEMA NFIP floodplain standards (Montgomery County Floodplain Regulations), and TCEQ water quality protections. Lake Conroe has a published 201-foot elevation normal pool β structures below 207 ft (100-yr flood elev) face elevation requirements post-Harvey. Bulkhead and pier permits issued by SJRA and USACE under Nationwide Permit 3 for maintenance of existing structures; new construction over navigable waters requires Section 404 Clean Water Act review. TX Natural Resources Code Ch. 33 coastal rules do not apply.
