Brevard County Code Ch. 62 and SJRWMD ERP rules require erosion and sediment control (ESC) for construction and land-disturbing activities. Grading permits require an ESC plan. Best Management Practices (BMPs): silt fencing, inlet protection, stabilized construction entrances, turbidity curtains around in-water or near-water work (Indian River Lagoon, Banana River, St. Johns River basin), straw wattles, and erosion blankets on slopes. Disturbed areas must be stabilized with vegetation or mulch within 14 days. Inspections required during construction. Sediment discharge into lagoon is a particularly serious violation given ongoing lagoon restoration efforts. Permanent stabilization required upon completion.
Missing ESC: stop-work order and $250-$2,500 fines. Sediment discharge to lagoon/river: $1,000-$25,000 per day under FDEP enforcement plus FL Β§403 penalties. Failure to stabilize within 14 days: daily fines.
