Fences in Chapel Hill must comply with the Town's Land Use Management Ordinance (LUMO - Appendix A to the Code of Ordinances), including dimensional standards in LUMO Section 3.8 and development standards in Article 5. Fences under 6 feet generally qualify for a Zoning Compliance Permit exemption; fences 6 feet and taller require a Zoning Compliance Permit. Fences may not encroach into the public right-of-way or block sight triangles. Historic District Overlay properties require a Certificate of Appropriateness under LUMO Section 3.6. Resource Conservation District and Jordan Lake Riparian Buffer properties have additional restrictions.
Chapel Hill's LUMO is the Town's primary zoning ordinance and is codified as Appendix A of the Town Code of Ordinances. Article 3 establishes zoning districts and dimensional standards, including the Dimensional Matrix in Section 3.8, and Article 3 Section 3.6 lists overlay districts: Historic District (HD), Resource Conservation District (RCD), Watershed Protection District, and Airport Hazard Overlay. Article 5 establishes development standards including landscape buffers, screening, and tree protection. Fences are accessory features that must comply with applicable dimensional standards (setback, height per zoning district) and may not obstruct sight triangles at intersections or driveways. Per the Town's residential permit guidance, fences six feet or taller require a Zoning Compliance Permit reviewed by the Planning Department at (919) 968-2728. Within the Historic District Overlay (Franklin-Rosemary established 1976, Cameron-McCauley, Gimghoul), the Historic District Commission must issue a Certificate of Appropriateness before any fence is installed, altered, or replaced; the Commission applies the Chapel Hill Historic Districts Design Principles & Standards. Within the Resource Conservation District (LUMO Section 3.6), fence and structure placement is limited to protect riparian areas. The Jordan Lake Riparian Buffer, established under 15A NCAC 02B .0267, restricts structures within 50 feet of perennial and intermittent streams in the Jordan watershed.
A fence six feet or taller installed without a Zoning Compliance Permit violates LUMO permit requirements. Fence placement that obstructs an intersection or driveway sight triangle violates LUMO sight-distance standards. Fences within the Historic District Overlay erected without a Certificate of Appropriateness violate LUMO Section 3.6. Fences inside the Resource Conservation District or Jordan Lake Riparian Buffer without overlay-specific authorization violate Section 3.6 and (for the Jordan Buffer) 15A NCAC 02B .0267.
