Beyond height, Sutter County's Zoning Code requires that fences and walls not obstruct driver visibility. On corner lots, no fence, wall, hedge or other obstruction over 30 inches above curb level is allowed in the clear-vision triangle, and ER/Ranchette ornamental fences must not restrict sight distance as determined by the Planning Director.
Sutter County's fence regulations focus on safety and visibility in addition to height. The Zoning Code (Chapter 1500, Table 1500-06-2) includes a corner-lot clear-vision (sight-distance) rule: on a corner lot, no fence, wall, hedge, sign, shrubbery, mound of earth, or other visual obstruction over 30 inches in height above the existing or planned curb elevation may be erected within the corner clear-vision triangle, so drivers can see cross traffic and pedestrians. When the Estate Residential (ER) or Ranchette (RAN) districts use the increased ornamental fence and wall heights allowed in the front or street-side setback, the code requires that 'walls and fences shall be designed and constructed so as not to restrict vehicular traffic sight distance as determined by the Director,' which is confirmed through Zoning Clearance review. Screening fences required as a condition of certain land uses (for example, around manufactured-home parks under Table 1500-06-1) carry a typical minimum height of 6 feet, with exact height, location, construction and materials set by the use permit. Swimming-pool barrier fences must additionally meet California pool-safety standards. Property owners should verify height, sight-triangle, and setback requirements for their specific zone and lot configuration with the Community Services Department before installing a fence.
A fence or hedge that violates the corner clear-vision rule (over 30 inches in the sight triangle) or that restricts required vehicular sight distance is a zoning violation. The County may require the obstruction be lowered, trimmed, or removed, and may issue notices of violation and administrative penalties. Required screening fences that are not installed or maintained per a use permit condition can place the underlying land-use approval in violation.
