NYC Building Code and Zoning Resolution limit residential fences to 6 feet in residence districts. Front yard fences are limited to 4 feet (6 feet on corner lots in certain conditions). Fences in non-residence districts may be up to 10 feet. No permit required for fences 6 feet or under at 1-2 family homes.
The NYC Building Code (Article 18 of the 1968 Code, Section BC 3112 of the current code) limits fences in residence districts to 6 feet above ground. Fences in conjunction with non-residential buildings or public playgrounds may reach 15 feet. In non-residence districts, fences may be up to 10 feet. The NYC Zoning Resolution Β§23-312 limits front yard fences to 4 feet above adjoining grade, except that corner lots may have 6-foot fences in the portion of the front yard between the side lot line and the prolongation of the side wall. Under 1 RCNY Β§101-14, homeowners of 1-2 family dwellings do not need DOB permits for fences 6 feet or under. Properties in Brooklyn's many landmark districts (e.g., Park Slope, Brooklyn Heights, Fort Greene, Clinton Hill) require Landmarks Preservation Commission (LPC) approval for visible fencing changes.
Fence exceeding height limits: DOB violation. Work without permit (when required): DOB violation with fines. LPC violation in landmark district: separate penalties.
