Fences and walls located in a required side, street side, or rear setback may be a maximum of 8 feet in height. Fences and walls may be located within required setbacks subject to these standards. Barbed wire and razor wire fences are prohibited in residential zones under CDC Chapter 18.210. Vision clearance is regulated separately under CDC Chapter 18.930 (Vision Clearance Areas), which defines a triangular sight-distance area at intersections of two non-arterial streets, a non-arterial street and a driveway, and a non-arterial street or driveway and a railroad, where at least one of the streets or driveways is 24 feet or more in width; the vision clearance triangle is measured 30 feet from the intersection along the right-of-way or property lines. Fences, walls, hedges, and other obstructions taller than 3 feet are not permitted within the vision clearance triangle. On corner lots, the front-yard fence-height limits also apply to the street side of the lot. Retaining walls are evaluated under CDC Chapter 18.210 and the Oregon Residential Specialty Code adopted under ORS 455.020 rather than as ordinary fences when they retain earth load. Building a fence or wall higher than the CDC Chapter 18.210 limits (3 feet in the local-street front setback, 6 feet in an arterial/collector front setback, or 8 feet in a side/street side/rear setback), or placing any fence over 3 feet within a CDC Chapter 18.930 vision clearance triangle, is enforceable by Tigard Code Compliance through warning notices, civil penalties, and orders to remove or lower the fence. Barbed or razor wire residential fences violate CDC Chapter 18.210 and must be removed.
