In unincorporated San Benito County, fences and walls up to 3 feet may stand in any front yard, and fences up to 6 feet in any side or rear yard, under County Code Section 25.07.013. Where land grades abruptly at a boundary, a fence may reach the upper lot's limit but never more than 12 feet.
San Benito County's Zoning Code (Title 25) governs fences on unincorporated land through Section 25.07.013, Fences, Walls, and Screening. The base rule is that a fence or wall not exceeding 3 feet in height may occupy any required front yard area, while a fence or wall not exceeding 6 feet in height may occupy any side or rear yard area. Each fence, wall, and screen in residential zones must also comply with the height limits and locations shown in Table 25.07-J, and fences in commercial and industrial zones must comply with Table 25.07-K; the designated approving authority may increase the maximum height through development review. Where there is an abrupt shift in the height of the land at the boundary line between two properties, the lower property owner may erect a fence or wall on the boundary up to the height limit applicable on the upper property, but in no event more than 12 feet in height. Corner and driveway visibility is separately limited by Section 25.29.013. These are county standards for unincorporated areas only; the cities of Hollister and San Juan Bautista set their own fence rules under their own municipal codes.
A fence built taller than the limits in Section 25.07.013 or Tables 25.07-J/K is a zoning violation subject to San Benito County code enforcement, which can order correction or removal and pursue administrative penalties and abatement of the nonconforming fence.
