In residential front-yard setbacks, only fences that are at least 70% open to the passage of light and air qualify for the taller 7-foot allowance. Under Humboldt County Code Section 314-73 (inland) and Section 313-74 (Coastal Zone), an 'open fence' in residential zones must be at least seventy percent (70%) open to the passage of light and air to use the 7-foot height allowance within the front-yard setback. Chain link or other woven wire fencing smaller than six (6) gauge is expressly prohibited inside the front-yard setback. Within the visibility triangle at intersections and driveways (Section 341-2), 'visibility obstruction' includes hedges, bushes, natural growth, buildings, structures, fences and signs over three feet in height -- but fences of a type which do not obstruct vision are exempted. Public Works guidance specifically suggests that chain link with 2-inch posts and 2-inch mesh (no privacy slats) is an acceptable tall-fence option within the visibility triangle.
Installing solid fencing, chain link with privacy slats, or sub-6-gauge wire in a front-yard setback violates Section 314-73/313-74. Solid or view-blocking material installed in the road visibility triangle violates Section 341-2 and can be ordered removed by Public Works under the enforcement provisions of Chapter 341. Continued violations may result in administrative fines and abatement at the owner's expense.
