Section 34-1742(d) of the Land Development Code prohibits nontraditional materials, listing tires, mufflers and hubcaps as examples, and bars fabric sheets or nets and plastic, metal or vinyl sheets or slats used as part of a fence or attached to one for privacy or required screening. Subsection (f) keeps barbed wire, spire tips, sharp objects, hog wire, game fence, horse wire and electrically charged fences at least 100 feet from any residential area or Residential Zoning District under separate ownership, with narrow exceptions for livestock control on bona fide agricultural land, Director-approved temporary construction security, and hazard enclosures. Electrical fences must meet the National Electrical Safety Code.
Using banned materials is a Land Development Code violation. The Hearing Examiner can impose $25 to $1,000 per day for a first violation and $50 to $5,000 per day for repeats.
