Scottsdale's Zoning Ordinance regulates fences on property lines. Fences up to 6 feet are generally permitted on side and rear property lines. The height is measured from the inside of the enclosure. Scottsdale allows walls, fences, and hedges up to 6 feet in height on the property line and within the parcel except in the front yard setback. In the side and rear yards, fences up to 8 feet may be permitted under certain conditions. The height of walls and fences is measured from the inside of the enclosure, which is important on sloped lots. The finished side of a fence must face the neighboring property (for wooden fences). Arizona does not have a statutory spite fence law, but nuisance claims apply under common law. For agricultural properties, ARS Β§3-1424 governs partition fence responsibilities between neighbors. Scottsdale's code enforcement division handles fence-related complaints. Construction of walls and fences in a Public Utility Easement requires written approval from all utility companies with easement rights.
Fences exceeding height limits or violating setback requirements may be subject to code enforcement action and required modification or removal.
