Kansas law largely leaves residential boundary fences to private agreement between neighbors. Unlike some states, Kansas does not impose a general partition-fence cost-sharing requirement on residential property owners; the state's fence-line statutes apply mainly to agricultural and livestock-containment situations. In Wichita, a property owner who wants a boundary fence may build it entirely on their own land at their own expense, or may negotiate a shared-cost arrangement with the neighbor that should be documented in writing and recorded if substantial. Fences built directly on the property line typically become joint property and require both owners' consent for changes, while fences built one to several inches inside the property line remain the sole property of the builder. Local custom favors orienting the finished or smooth side of the fence toward the neighboring property, although this is not legally required in Wichita. Disputes over property lines should be resolved through a licensed land surveyor before construction, and disputes after construction may require small-claims-court action. Tree branches, leaves, and roots that cross the property line may be trimmed back to the property line at the affected owner's expense, but the tree itself cannot be cut down.
