Vertical openings in the barrier cannot exceed 4 inches, and openings under the fence cannot exceed 2 inches. Solid barriers may not have indentations or protrusions that create handholds or footholds. Gates must open outward from the pool, be self-closing and self-latching, and have the release mechanism at least 54 inches above the ground. Where a dwelling wall serves as part of the barrier, doors leading to the pool area must be equipped with alarms (sounding for 30 seconds within 7 seconds of opening) or the pool itself must have a power safety cover meeting ASTM F1346. Above-ground pools with walls at least 48 inches tall may use the pool wall as the barrier provided ladders are removable or lockable. Permits for pool installation are issued by OCI and inspections include barrier verification before water is added. Failure to maintain a compliant barrier is a code violation and can also create civil liability under Kansas attractive nuisance doctrine.
