Denton County does not require fence permits in unincorporated areas. Texas counties lack zoning and building code authority for residential fencing. Property owners may build fences without county approval unless they affect county road rights-of-way or floodplains.
Unincorporated Denton County has no fence permit requirement because Texas counties cannot impose zoning or residential building codes outside their limited statutory authority. Property owners may construct fences on their own land without obtaining a county permit, paying fees, or submitting plans. The only exceptions involve fences that would encroach on county road rights-of-way, recorded utility easements, or FEMA-designated floodplains. Fences in floodplains near Lewisville Lake, Lake Ray Roberts, or Denton Creek tributaries may require a floodplain development permit review by Denton County. HOA-governed subdivisions frequently require architectural review committee approval before fence construction, with submissions for material type, color, height, and placement. This is a private covenant requirement, not a county permit. Incorporated cities within Denton County (such as Denton, Flower Mound, Lewisville, and Little Elm) each have their own fence permit requirements.
No county fence permit violations exist. Encroaching on county rights-of-way may result in required removal by Public Works. Floodplain violations can affect federal flood insurance eligibility and result in enforcement by the county floodplain administrator.
