Chattanooga City Code Sec. 38-51(d)(2) states plainly that fence and wall height are regulated by the Building Code, so permitting flows through the adopted building code rather than a standalone fence permit. In practice, most residential fences 7 feet or lower do not require a building permit, while taller fences and structural walls do. Even permit-exempt fences must be entirely on the owner's property, clear of rights-of-way and easements, and comply with corner sight-visibility. In unincorporated Hamilton County, confirm zoning, setback, and plat requirements with County Development Services before construction, as a permit exemption does not waive zoning compliance.
Installing a permit-required fence without one, or encroaching into a right-of-way or easement, can result in correction orders, removal at the owner's expense, and zoning-enforcement penalties.
