Ohio Residential Code (OAC 4101:8, adopting IRC Appendix G / Section R326) requires any residential swimming pool, spa, or hot tub capable of holding water more than 24 inches deep to be enclosed by a barrier at least 48 inches high measured from the exterior finished ground surface. Openings in the barrier must not allow passage of a 4-inch sphere, and gates must be self-closing, self-latching, and open outward away from the pool. The latch release must be at least 54 inches above grade if on the pool side of the gate. Where a dwelling wall forms part of the barrier, doors leading to the pool area must have alarms or the pool must have a powered safety cover. Canal Winchester Development Department verifies barrier compliance during pool permit inspections, which are required before the pool is filled. Above-ground pools with walls at least 48 inches high may use the pool wall as the barrier if the ladder is removable or lockable.
Noncompliance is a zoning and building code violation. Initial notice provides 10 days to correct; continued violation may result in fines up to $500 per day, pool drainage order, and liability exposure under Ohio's attractive-nuisance doctrine for any injury.
