Pool fencing in Broome County is governed by the NY State Residential Code Appendix G and 19 NYCRR Part 1228, both of which mirror ICC requirements. Any residential pool capable of holding water 24 inches or deeper must have a barrier at least 48 inches above grade measured from the outside. Gates must be self-closing and self-latching, open outward from the pool, and the release mechanism must be at least 54 inches above the ground (or inside-mounted at least 3 inches below the top). Chain-link mesh may not exceed 2-1/4 inches unless slats reduce openings to 1-3/4 inches. Pool alarms required under NY Executive Law 387(14) for pools built or substantially modified after December 14, 2006. Code enforcement is at the city, town, or village level through the local CEO; Certificate of Compliance required before filling.
NY Uniform Code violations carry fines up to $1,000 per day of noncompliance under Executive Law 382. Pool cannot be filled or used until barrier passes inspection. Injury to a child on an unfenced pool exposes owner to substantial civil liability.
