New Mexico has adopted IRC Appendix G (Swimming Pools, Spas and Hot Tubs) statewide through the Construction Industries Division. Barriers surrounding any pool or in-ground spa deeper than 24 inches must be at least 48 inches tall measured from grade on the outside, with maximum 2-inch bottom clearance, no footholds wider than a 4-inch sphere in vertical members, and no horizontal members under 45 inches apart that create a ladder effect. Gates must open outward away from the pool, be self-closing and self-latching, with the release mechanism located at least 54 inches above the ground (or shielded if lower). Dwelling walls used as part of the barrier require door alarms on every door providing direct access to the pool. Bernalillo County Planning & Development and Albuquerque Planning both inspect barriers before issuing final pool permit sign-off; no pool may be filled or operated before this inspection passes. Above-ground pools with walls 48+ inches can serve as their own barrier if the ladder is removable or lockable.
Failing a barrier inspection halts pool filling and use. Re-inspection fees apply. Operating a non-compliant pool triggers fines of $100-$500 per violation plus potential civil liability under NM premises-liability law; homeowners insurers may deny coverage for accidents if barriers are non-compliant.
