Alabama has adopted the International Residential Code (IRC) and International Swimming Pool and Spa Code through the Alabama Energy and Residential Codes Board. These codes require residential pools deeper than 24 inches to be enclosed by a barrier at least 48 inches high with no gaps over 4 inches, self-closing and self-latching gates opening outward, and latches at least 54 inches above grade. Local jurisdictions may adopt stricter requirements but cannot weaken these state-adopted minimums. The Alabama Department of Public Health also regulates public pools under Chapter 420-3-23 of the Alabama Administrative Code.
Code violations may result in stop-work orders, denial of certificate of occupancy, civil fines through local building officials, and homeowner liability for drowning incidents.
