Newark enforces the NJ Uniform Construction Code (N.J.A.C. 5:23) which adopts the International Swimming Pool and Spa Code (ISPSC) for pool barrier requirements. All residential swimming pools, spas, and hot tubs must be enclosed by a barrier at least 48 inches high measured from the exterior side. Barrier openings must not allow passage of a 4-inch sphere. The bottom clearance must not exceed 2 inches on soft surfaces (grass, gravel) or 4 inches on hard surfaces (concrete). All gates must be self-closing and self-latching, with latches placed at least 54 inches above the ground on the pool side or equipped with a key lock. Chain link fences used as pool barriers must have openings no larger than 1.75 inches. A building permit is required for pool installation and the barrier is inspected before the pool can be used.
