Residential pool barriers in Noblesville are governed by Section 159.121 of the UDO (which requires a barrier at least four feet in height for permanent pools and/or a compliant safety cover) and by the Indiana Residential Code 2020, Section R326 (Swimming Pools, Spas and Hot Tubs) adopted statewide under IC 22-12 / 675 IAC 14-4.4. The IRC sets the technical floor: minimum 48-inch barrier height, no opening that allows a 4-inch sphere to pass, self-closing and self-latching gates that open outward away from the pool, and additional protections where a dwelling wall serves as part of the barrier.
Noblesville's local pool-barrier rule is in UDO Section 159.121: 'Permanent swimming pools shall be protected by a surrounding fence at least four feet in height, which is maintained to prevent access by small children or animals, and/or by a safety pool cover that meets all specifications set forth in the adopted Indiana Swimming Pool Code.' The fence may be located around the pool itself or around the property on which the pool is located. The statewide technical standard comes from the Indiana Residential Code 2020 (675 IAC 14-4.4 adopting the 2018 IRC), Section R326 - Swimming Pools, Spas and Hot Tubs - which incorporates Appendix G barrier rules. Key R326 provisions: (1) the top of the barrier shall be at least 48 inches above grade measured on the side of the barrier which faces away from the swimming pool; (2) openings in the barrier shall not allow the passage of a 4-inch-diameter sphere; (3) for fences where horizontal members are less than 45 inches apart, horizontal members shall be on the swimming pool side and spacing between vertical members shall not exceed 1-3/4 inches; (4) chain-link maximum mesh is 1-1/4 inch square unless slats reduce openings to 1-3/4 inches; (5) gates shall be self-closing and self-latching, open outward away from the pool, and the latch release shall be at least 54 inches above the bottom of the gate (or located on the pool side at least 3 inches below the top of the gate, with no opening larger than 1/2 inch within 18 inches of the release). Where a wall of a dwelling serves as part of the barrier (R326), doors with direct pool access must be equipped with an alarm complying with UL 2017, a self-closing/self-latching device, a powered safety cover complying with ASTM F1346, or an approved alternative. These IRC barrier rules are enforced statewide by Noblesville under IC 22-12. Non-permanent (portable) pools 'shall meet all accessory building structure regulations but are not subject to the safety and screening regulations of permanent pools' per UDO Section 159.121.
A permanent pool installed without a four-foot (UDO) and 48-inch (IRC) compliant barrier and without an approved ASTM F1346 safety cover violates Section 159.121 and the Indiana Residential Code. The Noblesville Department of Planning and Development can issue stop-use orders, require the pool to be drained until compliance is achieved, and assess civil penalties under the UDO. Common violations include failed self-closing gates, latches below 54 inches that are not pool-side, openings larger than 4 inches, and climbable objects within reach of the barrier.
