Operational restrictions in § 159.128: mobile food vehicles shall NOT interfere with or obstruct the free passage of pedestrians or vehicles along any street, sidewalk, road, or parking lot drive aisle, and shall NOT park within 20 feet of any intersection. Mobile food vehicles must hold all requisite health department, business, and resale licensures to sell food and beverages. The annual permit fee is $1,000 (set by Common Council); permits expire after one year. Compliance failure may result in revocation, suspension, or non-renewal. Enforcement: any mobile food truck operating without a valid Noblesville Mobile Food Vehicle Permit shall be deemed a public safety hazard and may be ticketed and impounded by Noblesville Code Enforcement (317-776-6325) and the Police Department. The property owner who permits the parking is also in violation. Indiana 2024 HEA 1258 (Indiana Code 16-42-5.1) streamlined Hamilton County Health Department permitting for mobile retail food establishments but does NOT preempt § 159.128's zoning-based location rules.
Parking in the downtown zoning district, in residential areas, within 1,000 ft of a permitted special event, or within 1,000 ft of the Farmer's Market is a § 159.128 violation. Parking within 20 ft of an intersection or obstructing pedestrians, vehicles, sidewalks, streets, or parking lot drive aisles is also a violation. Operating without a permit makes the vehicle a public safety hazard subject to ticket and impoundment. Property owner permitting parking is also in violation.
