The Florida Residential Swimming Pool Safety Act (FL Ch. 515) and Florida Building Code Section 454 apply countywide in Volusia and supersede any weaker local rules. All residential pools, spas, and hot tubs constructed after October 1, 2000 must have at least one of the following safety features: (1) a barrier at least 48 inches high with self-closing, self-latching gate with latch 54+ inches above grade and openings no greater than 4 inches; (2) approved pool safety cover; (3) exit alarms on all doors/windows providing direct access to the pool; or (4) self-closing, self-latching devices on doors with release mechanism 54 inches above threshold. Volusia County Code Ch. 22 and city codes (Daytona Beach, DeLand, Ormond, NSB, Deltona) enforce these standards. Inspection is required at permit final before pool use. Given Volusia's high drowning rates and year-round swimming weather, enforcement is strict. Sellers must disclose pool safety compliance under FL §515.27.
Non-compliant barriers: second-degree misdemeanor under FL §515.29 punishable by up to 60 days jail and $500 fine. Pool cannot be filled or used until code-compliant. Civil liability for drowning incidents is severe and not limited by barrier compliance.
