Contra Costa County, CA Fire Regulations: Backyard Fires (2026)

(h) Section 202 or Chapter 2 (Definitions) is amended to include the following additional defined terms: "Combustible Material. Rubbish, litter or material of any kind other than hazardous vegetation that is combustible and endangers the public safety by creating a fire hazard as determined by the fire code official." "Public Nuisance. A declaration by the fire code official that the presence of combustible materials on any parcel creates a fire hazard or threat to public safety (Health and Safety Code 14875 and 14876) or any violation of this code." (g) Section 112.4 is amended to read: "112.4 Violation penalties. Every person who violates any provision of this fire code is guilty of an infraction or misdemeanor in accordance with Health and Safety Code Section 13871 and Government Code Section 53069.4. The imposition of one penalty for any violation shall not excuse the violation or permit to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time. ... Each day that prohibited conditions are maintained shall constitute a separate offense."
