Backyard recreational fires are allowed in Rogers without a permit if they meet the fire code: at least 25 feet from structures (15 feet for a portable outdoor fireplace), burning only clean vegetation or firewood, constantly attended, with extinguishing equipment ready, and not during high wind or a burn ban.
A backyard recreational fire in Rogers is governed by the Rogers Fire Department Open Burn Policy and the adopted Arkansas Fire Prevention Code (IFC Chapter 3). A fire that meets the recreational-fire definition does not require a permit. Under IFC Section 307.4.2, a recreational fire must be at least 25 feet from any structure; a portable outdoor fireplace (chiminea or store-bought fire bowl) must be at least 15 feet away under Section 307.4.3, with an exception for one- and two-family dwellings. The Open Burn Policy further provides that approved containers must be at least 15 feet from a structure, and small burn piles (3 feet or less in diameter, 2 feet or less in height) require 25 feet of clearance. Backyard fires must be constantly attended until extinguished, with at least one 4-A rated portable fire extinguisher or equivalent (garden hose, water, dirt, or sand) immediately available. Acceptable fuel is vegetation such as limbs, leaves, and grass clippings; prohibited materials include plastic, lumber, construction debris, trash, and cardboard. Fires cannot be conducted when wind exceeds 10 mph, must be extinguished if weather changes raise the risk of spread, and may be ordered out immediately if they create a nuisance or hazard. Any fire that goes beyond a recreational fire requires a burn permit, which is void during a declared burn ban.
Leaving a backyard fire unattended, exceeding size or clearance limits, burning prohibited materials, or burning in unsafe wind or during a burn ban violates the adopted fire code and city policy. The fire may be required to be extinguished immediately and a citation issued; nuisance or hazardous fires can be ordered out at any time.
