Arkansas allows consumer (I.C.C. Class C common) fireworks under state law, but A.C.A. 20-22-704 expressly preserves the power of any municipality to regulate or prohibit the sale or use of fireworks. Rogers exercises that authority. Per the City of Rogers, fireworks may be used only within the dates of July 2 through July 4 of each year, between 11:00 a.m. and 11:00 p.m. Any aerial fireworks device attached to a stick, commonly called a bottle rocket, and any similar device is prohibited regardless of its name. No fireworks may be used or discharged on any city-owned property (except city-sponsored public displays), and no fireworks may be used on private property without the property owner's consent. Statewide, A.C.A. 20-22-711 allows consumer fireworks to be used from June 20 through July 10 and December 10 through January 5, but Rogers' narrower window controls inside city limits. State law also bans sky lanterns (A.C.A. 20-22-717) and prohibits igniting fireworks within 600 feet of a church, hospital, or public school, or within 200 feet of a fireworks sales location (A.C.A. 20-22-713). Sales to children under 12 are unlawful (A.C.A. 20-22-712).
State fireworks violations are a misdemeanor punishable by a fine of $50 to $200, up to 90 days in jail, or both (A.C.A. 20-22-705). Discharging on city property, using banned bottle rockets, or firing outside the July 2-4 window in Rogers can result in citation; confiscation of contraband fireworks is authorized under A.C.A. 20-22-714.
