Outdoor burning rules in Rogers, AR — also called the burn ban, open burning, or fire restriction ordinance — set when you can burn yard waste, debris, or run a recreational fire.
Open burning in Rogers requires a free permit from the Rogers Fire Department unless the fire qualifies as a recreational fire. Permits are valid only for the day issued, allow burning dawn to dusk, are void during any burn ban, and only vegetation may be burned. Burning is prohibited when wind exceeds 10 mph.
The City of Rogers regulates outdoor burning through the Rogers Fire Department Open Burn Policy under the adopted Arkansas Fire Prevention Code (AFPC Volume 1, Chapter 307). Unless a fire meets the recreational-fire definition, a burn permit is required and can be obtained free through the Fire Department website or by visiting fire administration during business hours (Monday-Friday, 7:30 a.m.-4:30 p.m.). Permits are valid only for the date of issuance; a new permit is required for each day of burning. A permit allows burning from dawn to dusk, and unless a Fire Marshal authorizes otherwise, all fires must be extinguished at dusk. Acceptable materials are limbs, leaves, grass clippings, and other vegetation. Prohibited materials include plastic, lumber, construction materials, trash, and cardboard. Open burning is not allowed when wind speeds exceed 10 mph. Burn piles must be at least 50 feet from any structure, with exceptions: 15 feet for approved containers, and 25 feet for piles 3 feet or less in diameter and 2 feet or less in height. Any permit obtained through the automated process is void if a burn ban has been issued by the Governor of Arkansas, the Benton County Judge, the Rogers Fire Chief, or the Rogers Fire Marshal. Statewide, ADEQ Rule 18.602 prohibits open burning of refuse, garbage, and trade waste; residential yard waste is exempt under Rule 18.603.
Burning without a required permit, burning prohibited materials (plastic, lumber, trash, cardboard), burning during a burn ban, or burning in winds over 10 mph violates the city policy and adopted fire code, and the fire may be required to be extinguished immediately. The Burn Permit page notes violations are punishable by fines and/or imprisonment.
