DuPage County's adopted Fire Code requires property owners in unincorporated areas to cut down and remove weeds, grass, vines, and other combustible growth capable of igniting and endangering property. Accumulations of combustible waste in yards, lots, and alleys are also prohibited, and hot ashes must be kept at least 10 feet from combustibles.
Section 304.1.2 of the DuPage County Fire Code (2015 IFC as adopted) states that "Weeds, grass, vines or other growth that is capable of being ignited and endangering property, shall be cut down and removed by the owner or occupant of the premises." Section 304.1.1 prohibits accumulations of wastepaper, wood, hay, straw, weeds, litter, or other combustible or flammable waste on roofs, in courts and yards, on vacant lots, in alleys, parking lots, open spaces, or beneath grandstands, bleachers, piers, wharves, or manufactured-home/RV undersides.
Section 305.2 requires hot ashes, cinders, smoldering coals, or other materials subject to spontaneous ignition to be stored at least 10 feet (3,048 mm) away from any combustible material, or stored in noncombustible covered receptacles. Outdoor ground-mounted photovoltaic arrays and energy storage systems require a 10-foot brush-free perimeter (Chapter 12). Permitted fireworks magazines require a 25-foot clearance of brush, dry grass, leaves, trash, and debris (Sec. 5604). The County also references the International Wildland-Urban Interface Code where applicable.
Violations of the Fire Code allow the Fire Code Official to issue notices of violation and orders to abate. If the owner does not comply, the County may abate the hazard and recover the cost as a lien against the property. Continuing violations may be cited daily. The County Code Section 30-17/30-26 open-burning fines ($500-$1,000) apply if cleared brush is burned rather than hauled away.
