Any new, modified, or relocated driveway connecting to a DuPage County highway requires a Highway Permit from the DuPage County Division of Transportation under the county's Highway Rights-of-Way Permit and Fee Ordinance (effective 03/01/2023). DuPage County regulates driveway access onto county highways through the DuPage County Highway Rights-of-Way Permit and Fee Ordinance (effective March 1, 2023), administered by the DuPage County Division of Transportation (DuPage DOT). Any new driveway, curb cut, widening, or relocation that ties into a county-maintained highway requires a Highway Permit before any work begins in the right-of-way. Applications are accepted by the Highway Permits Manager (hwypermits@dupagecounty.gov / 630-407-6900) and are reviewed for sight distance, drainage, grade, surface, and effect on adjacent traffic operations.
Construction within the county right-of-way must conform to the Illinois Department of Transportation (IDOT) "Standard Specifications for Road and Bridge Construction," together with the DuPage DOT "General Notes and Specifications." Permit holders may only perform daytime lane closures between 9:00 AM and 4:00 PM, are barred from closing lanes during snow operations, and must notify DuPage DOT at least 48 hours before commencing work. The permit also obligates the applicant to restore disturbed topsoil, seed, and erosion-control measures after construction.
The DuPage DOT permit applies only to driveways accessing county-maintained highways. Driveways connecting to a municipal street (the typical situation inside Naperville, Wheaton, Downers Grove, and other DuPage municipalities) are governed by that municipality's code, not the county ordinance. Driveways onto a state highway (e.g., IL Route 53, IL Route 64) require an IDOT Highway Permit from IDOT District 1 instead. Property owners unsure which agency has jurisdiction should call DuPage DOT at 630-407-6900 before applying.
Constructing or modifying a driveway in the DuPage County right-of-way without a Highway Permit is a violation of the Highway Rights-of-Way Permit and Fee Ordinance and may result in a stop-work order, removal of the unauthorized improvement at the owner's expense, and recovery of restoration costs by the county. Continued unauthorized work may be referred to the State's Attorney for civil enforcement under 605 ILCS 5 (Illinois Highway Code).
