Tarrant County has no brush clearance or defensible space mandate for unincorporated properties. Outdoor burning for brush disposal is allowed except during county-declared burn bans.
Unincorporated Tarrant County does not require property owners to clear brush, maintain defensible space, or manage fuel loads around structures. Texas counties have no zoning power to enact such ordinances. Brush burning on private property for vegetation disposal is permitted under Texas Commission on Environmental Quality rules (30 TAC Chapter 111) except during burn bans. TCEQ requires notification to the Texas Forest Service before burning, a 300-foot setback from neighboring structures, adequate water or equipment on site, and attending the fire until fully extinguished. Tarrant County Commissioners Court routinely issues burn bans during summer and drought periods under Local Government Code 352.081. The Fire Marshal at 817-838-4660 enforces burn bans. HOA deed restrictions may impose private brush maintenance rules.
Burn ban violation: Class C misdemeanor, up to $500. TCEQ outdoor burning violations: administrative penalties up to $25,000 per day. HOA vegetation violations enforced civilly.
