Fire pit rules in Stuart, FL β also called outdoor burning, recreational fire, or open flame ordinances β cover fuel types, clearances, and when burning is allowed.
Recreational fires β campfires, bonfires, and backyard fire pits β are allowed in Martin County without a county permit, but must be no larger than 3 feet in diameter, limited to 1 cubic yard of burnable material, and located at least 25 feet from any structure or combustible material (per Martin County Fire Rescue Open Burn Guidelines and NFPA 1).
Martin County Fire Rescue enforces open burning under the county code, Florida Statutes ch. 590, and NFPA 1 Fire Code (referenced in Ch. 79, Fire Prevention and Protection). Recreational fires must be no more than 3 ft in diameter and contain 1 cubic yard or less of fuel, must be 25 ft from structures or combustible material (or contained in an approved chiminea/outdoor fireplace), and must remain attended while visible flame, smoke, or emissions are present. Burning is only authorized when the Fire Danger Index indicates a low or moderate hazard. Cooking fires for food on residential property are allowed without a permit.
Leaving a recreational fire unattended is unlawful. Code Enforcement and Fire Rescue can issue citations; reckless burning that endangers persons or property may be prosecuted under Fla. Stat. 590.28 (1st-degree misdemeanor). During declared burn bans, all open burning is prohibited.
