Fire pit rules in Houston, TX β also called outdoor burning, recreational fire, or open flame ordinances β cover fuel types, clearances, and when burning is allowed.
Houston prohibits open burning within city limits. Recreational fire pits are permitted only in approved containers (manufactured fire pits, chimineas). Open-flame devices must be 10 feet from combustible construction. Sky lanterns are banned.
Open burning is illegal within Houston city limits under the adopted International Fire Code with Houston Amendments and TCEQ regulations. Recreational fires are permitted only in manufactured fire pits, chimineas, or other approved containers designed for outdoor use. Under IFC 308.3.1, open-flame devices must maintain 10 feet from combustible construction, except for single and two-family dwellings or sprinkler-protected buildings. Sky lanterns with open flames are specifically banned. BBQ pits and grills do not require permits. In non-sprinkled apartment buildings, charcoal pits and small tabletop propane grills (cylinders 2.5 lbs or less) are permitted on patios and balconies only. The Houston-Galveston-Brazoria area is an EPA ozone nonattainment zone, adding air quality restrictions on outdoor burning.
Fire code violation: citation and fines. Report illegal burning to HFD Fire Prevention at 832-394-6900 (daytime) or 713-884-3131 (after hours).
