NYSDEC brush burn ban in effect statewide March 16 through May 14 annually under 6 NYCRR Part 215. Outside ban window, residential brush burning allowed only in towns under 20,000 population.
Most Dutchess County towns qualify under the population threshold (City of Poughkeepsie and Town of Poughkeepsie do NOT qualify). Only on-site grown brush less than 6 inches diameter may be burned. No burning of leaves, garbage, tires, or construction debris anywhere in the state. Violations: up to 2,500 first offense.
First offense: up to 2,500. Subsequent: up to 5,000 per day. Violations enforced by DEC Environmental Conservation Officers.
