Open burning is largely prohibited in Nassau County. NYSDEC 6 NYCRR Part 215 bans burning of household trash statewide and prohibits ALL open burning of brush from March 15 to May 15 annually. Nassau towns (population over 20,000) cannot permit residential brush burning even outside the seasonal ban.
Under NYSDEC Part 215, residential brush burning is only allowed in towns with populations under 20,000. All Nassau County towns exceed this threshold, so residential brush burning is effectively banned year-round countywide. The statewide March 15-May 15 burn ban applies to all brush burning. Permitted exceptions include small cooking fires, ceremonial/religious fires, and on-site burning of agricultural materials by farmers. Burning of household trash, leaves, tires, construction debris, and treated wood is prohibited with no exceptions.
NYSDEC civil penalties range from $500 for first-offense residential violations up to $15,000 per day for commercial or repeat violations. Local fire codes may impose additional fines of $250-$1,000.
