All Nassau County towns exceed this threshold, so residential brush burning is effectively banned year-round countywide. The statewide March 15-May 15 burn ban applies to all brush burning. Permitted exceptions include small cooking fires, ceremonial/religious fires, and on-site burning of agricultural materials by farmers. Burning of household trash, leaves, tires, construction debris, and treated wood is prohibited with no exceptions.
NYSDEC civil penalties range from $500 for first-offense residential violations up to $15,000 per day for commercial or repeat violations. Local fire codes may impose additional fines of $250-$1,000.
