Outdoor burning rules in Spring Hill, FL — also called the burn ban, open burning, or fire restriction ordinance — set when you can burn yard waste, debris, or run a recreational fire.
Outdoor burning in Spring Hill is governed by Chapter 12 of the Hernando County Code (Fire Prevention and Protection), the Florida Fire Prevention Code (8th Edition, NFPA 1, 2021), and Florida Administrative Code Chapter 5I-2 (Florida Forest Service - Open Burning). The Florida Forest Service has exclusive statutory authority under FS Chapter 590 to issue authorizations for pile burning; non-permitted pile burning is prohibited. Hernando County, through Ordinance No. 2025-02 adopted March 12, 2025, amended Chapter 12 to align with current NFPA standards and the Florida Building Code and gave the Hernando County Fire Chief authority to recommend a burn ban to the County Administrator for fast administrative action when wildland fire risk is high. Under Chapter 12, Article VI, when a burn ban is in effect (most recently April 14, 2026 and April 27, 2025), all outdoor burning not specifically permitted by the Florida Forest Service is prohibited; only contained gas or charcoal grills under attended cooking are excepted. Yard-waste and household-trash burning is prohibited at all times under FAC 5I-2.004.
Three layers of regulation apply. First, the Florida Fire Prevention Code (FFPC), 8th Edition, adopted under FS § 633.202 effective December 31, 2023 (incorporating NFPA 1, 2021), permits recreational fires up to 3 feet in diameter and 2 feet high with a 25-foot clearance to structures, and bonfires of larger size only with permit from the AHJ (Hernando County Fire Rescue under Chapter 12 of the County Code). Second, FAC Chapter 5I-2 (Florida Forest Service - Open Burning) and FS Chapter 590 govern wildland and pile burning: FAC 5I-2.004 (Open Burning Not Allowed) prohibits burning of household garbage, tires, plastics, treated lumber, rubber, paint, and other hazardous or polluting materials. FAC 5I-2.006 (Open Burning Allowed) permits yard-waste pile burning only with Florida Forest Service authorization and only when specific setback, KBDI, and weather conditions are met. The Florida Forest Service Withlacoochee Forestry Center is the wildfire AHJ for Hernando County. Third, Chapter 12 of the Hernando County Code governs fire prevention and protection within unincorporated areas (including Spring Hill) and the City of Brooksville. Hernando County Ordinance No. 2025-02, adopted March 12, 2025, amended Chapter 12 to update outdated language, reference current NFPA standards and the Florida Building Code, and create a process enabling the Hernando County Fire Chief to recommend a burn ban to the County Administrator for fast administrative action when wildland fire risk is high - rather than waiting for the next Board of County Commissioners meeting. Any administrative burn ban is subject to review by the Board at its next meeting. Under Chapter 12, Article VI, when a burn ban is declared (April 14, 2026, citing a Keetch-Byram Drought Index of 509, and April 27, 2025), the ban prohibits all outdoor burning that has not been specifically permitted by the Florida Forest Service, including bonfires, campfires, and burning of vegetation (yard) debris. Cooking on attended and monitored barbecue equipment is permitted so long as that equipment is a contained gas or charcoal grill. Reports of suspected violations go to the Hernando County Communications Center at (352) 754-6830.
Open burning of prohibited materials violates FAC 5I-2.004 and may be enforced by both the Florida Forest Service Withlacoochee Forestry Center and Hernando County Fire Rescue. Pile burning without a Florida Forest Service authorization violates FS Chapter 590 and FAC 5I-2. Burning during a Hernando County burn ban violates Chapter 12, Article VI of the Hernando County Code and is enforced by the Hernando County Sheriff's Office and HCFR. FFPC violations are subject to FS § 633.228 penalties and Chapter 12 enforcement. Report violations to (352) 754-6830 or HCFR at (352) 540-4353.
