Violations of the adopted California Fire Code are misdemeanors under California Fire Code section 109.3 and may be abated by order of the fire code official, who can require removal or relocation of a non-compliant tank. Improperly sited or unprotected tanks discovered during inspection must be corrected. A leaking or improperly installed tank that contributes to a fire can expose the owner to civil and criminal liability.
