New Mexico's LPG Bureau regulates propane storage, installation, and transport statewide under uniform safety codes, preempting local variations on tank specifications, setbacks, and installer licensing.
The New Mexico Liquefied Petroleum Gas Act (NMSA 70-5) and NMAC 19.15.16 give the LPG Bureau, within the Construction Industries Division, exclusive authority over propane tank installation, container specifications, setback distances, and installer certification statewide. The state adopts NFPA 58 (Liquefied Petroleum Gas Code) by reference. Residential tanks under 125 gallons typically require 10-foot setbacks from buildings and ignition sources; larger commercial tanks require greater distances. Only state-licensed LPG contractors may install fixed systems. Local governments cannot impose additional licensing or technical requirements that conflict with state code.
Unlicensed installation or noncompliant storage is a misdemeanor with fines up to $1,000 per violation, plus mandatory correction orders and potential civil liability for resulting incidents.
