Illinois regulates the storage, handling, and transport of liquefied petroleum gas statewide under the LPG Act, adopting NFPA 58 standards uniformly through the Office of the State Fire Marshal.
Under 430 ILCS 15, the Illinois Liquefied Petroleum Gas Act gives the Office of the State Fire Marshal exclusive authority over the design, construction, location, installation, and operation of LPG containers and equipment. State rules at 41 Ill. Adm. Code 200 incorporate NFPA 58, the Liquefied Petroleum Gas Code, by reference, making it the uniform standard statewide. Container setback distances, tank capacity limits at residences, and dispensing operations are governed by these state rules and are not subject to override by municipalities. Sellers, installers, and transporters must hold state licenses. Most homes are limited to small portable cylinders unless properly permitted larger tanks meet setback requirements.
Operating without a license or violating storage rules can result in fines, license suspension, and criminal prosecution under the LPG Act.
