Tulare does not maintain a stand-alone propane ordinance. By TMC § 3.08.010, the city adopts the California Fire Code (Title 24 Part 9), whose Chapter 61 (Liquefied Petroleum Gases) and NFPA 58 (LP-Gas Code) control container size, location, setbacks and permitting. Residential portable cylinders up to 5 lb may be stored indoors per CFC § 6109.4; larger tanks (any LP-gas exceeding 125 gal aggregate water capacity) require a Tulare Fire Department operational permit per CFC § 105.5.30.
TMC § 3.08.010 adopts the California Fire Code (currently the 2022 edition, Title 24 Part 9 of the California Code of Regulations) including Appendices B–N. CFC Chapter 61 (Liquefied Petroleum Gases) and the referenced NFPA 58 (California LP Gas Code) govern propane: container location/setback (Table 6104.3), maximum residential portable cylinder size (≤1 lb non-refillable inside, ≤5 lb refillable inside per § 6109.4), distance from buildings and property lines, fencing, signage, hose/regulator standards. Outdoor stationary residential tanks (typical 250–500 gal) must comply with NFPA 58 distance requirements: a 500-gal tank needs ≥10 ft from any building or property line. CFC § 105.5.30 requires an operational permit from the Fire Code Official (Tulare Fire Marshal) to store, use or handle LP-gas of more than 125 gallons aggregate water capacity. Installation of fixed LP-gas piping/appliances also requires a mechanical/plumbing permit through Tulare Building Division. Bulk LP-gas plants and tank refilling stations are also regulated by Cal. Code Regs. tit. 8 § 470 (DIR Cal-OSHA permit) and the State Fire Marshal.
Operating without the required CFC § 105.5.30 permit, or storing tanks in violation of NFPA 58 setbacks, is a violation of TMC § 3.08.010 enforceable by stop-work order, citation, or misdemeanor for willful/repeat violations per CFC § 109. Bulk plants without Cal-OSHA permits face state-level enforcement under 8 CCR § 470.
