TMC Ch. 3.08 governs fireworks. § 3.08.080 (Safe and sane fireworks) authorizes the sale of California-approved 'Safe and Sane' fireworks under permit. Permit applications must be received by the Fire Marshal's Office by 5:00 p.m. May 1 of each year, and applicants must satisfy all municipal licensing and Fire Department safety conditions. All trace of fireworks booths must be removed within 48 hours after close of business on July 6. Discharge is permitted only on private property — never on public streets, sidewalks, parks or alleys. § 3.08.040 prohibits 'dangerous fireworks' as defined in Cal. Health & Safety Code §§ 12500–12727 (the State Fireworks Law), including aerials, firecrackers, bottle rockets and any device that explodes, travels laterally, or shoots into the air. The City of Tulare Fire Department FAQ states explicit 'zero tolerance' on illegal/dangerous fireworks.
Possession, use or sale of dangerous (illegal) fireworks is a misdemeanor under Cal. Health & Safety Code § 12700 et seq., punishable by fines up to $1,000 and/or up to 1 year in county jail. Discharge of legal Safe-and-Sane fireworks outside permitted dates/places, or on public property, is an infraction citation under TMC § 3.08.080. SB 839 (2018) also authorizes administrative civil fines up to $1,000 per violation for illegal fireworks.
