Smoke-detector requirements apply uniformly across Dutchess County through NYS Uniform Code adoption. For existing homes, General Business Law 399-ccc (effective April 1, 2019) mandates that any replacement battery-only alarm be a 10-year sealed lithium unit - ionization or photoelectric acceptable, but user-replaceable 9V batteries are phased out. Retail sellers can only sell compliant models. NY Executive Law 378-c (Amanda's Law, 2010) requires carbon monoxide alarms in all residences with fossil-fuel appliances or attached garages. Rental units require working alarms at the start of each tenancy under NY Real Property Law. Dutchess town and city building inspectors verify at certificate of occupancy; volunteer and career fire departments in Poughkeepsie, Beacon, Arlington, Hyde Park, and elsewhere conduct public-education inspections.
Failure to maintain alarms: $250-$1,000 per unit per NY Uniform Code. Landlord non-compliance: up to $1,000 per violation plus tenant displacement costs. Selling non-compliant alarms: GBL 399-ccc up to $250 per unit.
