NY Executive Law §378(5-a) and 19 NYCRR Part 1225 require smoke alarms in all one- and two-family dwellings sold, leased, or modified after April 1, 2019 to contain a non-removable 10-year sealed battery or be hard-wired with battery backup. Alarms must be placed inside each sleeping room, outside each separate sleeping area, and on every level including basements. Amanda's Law (Executive Law §378(5)) mandates carbon monoxide alarms on every level of any residence with a fuel-fired appliance (gas furnace, boiler, fireplace, water heater) or an attached garage. CO alarm placement is within 15 feet of every sleeping area. Binghamton, Johnson City, Vestal, and Endicott code officers inspect at sale and lease, and landlords must certify compliance on residential leases.
NYS violations are Class B misdemeanors — up to $250 fine and/or 15 days jail for each day of violation. Landlords face additional civil penalties.
