New Jersey requires smoke alarms on every level and outside each sleeping area in one- and two-family homes under N.J.A.C. 5:70. Before any sale or lease, owners must obtain a certificate of smoke, carbon-monoxide and fire-extinguisher compliance from the local fire official.
Under the NJ Uniform Fire Code, N.J.A.C. 5:70-4.19, one- and two-family dwellings must have smoke alarms installed on each level of the premises and outside of each separate sleeping area. Carbon-monoxide alarms meeting UL 2034 are required in any home with a fuel-burning appliance or attached garage (N.J.A.C. 5:70-4.9). Before a home is sold, leased or has a change of occupancy, the owner must obtain a Certificate of Smoke Alarm, Carbon Monoxide Alarm and Portable Fire Extinguisher Compliance from the local enforcing agency (N.J.A.C. 5:70-2.3). These are state requirements enforced by your municipal fire official; Morris County sets no separate rule.
Selling or renting without the required compliance certificate, or missing alarms, results in local fire-official penalties and blocks the change of occupancy.
