North Miami enforces the Florida Building Code, Residential (FBC-R) Section R314 and the Florida Fire Prevention Code (NFPA 72) for smoke alarms. New and substantially renovated dwellings require interconnected, hard-wired alarms with battery backup in every sleeping room, outside each sleeping area, and on every story. F.S. 553.883 requires 10-year sealed-battery alarms when only battery-powered alarms are used.
All construction in North Miami follows the Florida Building Code as adopted by Miami-Dade County under the High-Velocity Hurricane Zone (HVHZ) provisions. FBC-R Section R314 requires smoke alarms in each sleeping room, outside each separate sleeping area in the immediate vicinity of bedrooms, and on each additional story including basements. New-construction and substantially renovated dwellings must use alarms that are hard-wired to the building electrical system with battery backup and that are interconnected so activation of one alarm activates all alarms. For existing one- and two-family dwellings where battery-only alarms are permitted as replacements, Florida Statute 553.883 (effective January 1, 2015) requires the alarm to be powered by a non-removable, non-replaceable 10-year sealed battery. Combination smoke/CO alarms or separate CO alarms are required where fuel-burning appliances or attached garages are present per FBC-R R315. Missing, disabled, or non-compliant smoke alarms can fail building inspections, prevent issuance of a Certificate of Occupancy, and trigger Code Compliance citations with Special Magistrate fines. Landlords who fail to maintain alarms in rental units expose themselves to civil liability under Florida landlord-tenant law in addition to code penalties.
