Hialeah enforces the Florida Building Code Residential Section R314 and NFPA 72 for smoke alarms. Alarms are required in every sleeping room, outside sleeping areas, and on each story including basements. Florida Statute 553.883 mandates 10-year sealed-battery alarms when battery-powered units are installed or replaced.
Per FBC R314, smoke alarms must be installed inside each sleeping room, outside each separate sleeping area within 21 feet of bedroom doors, and on every story of the dwelling, including basements. New construction requires hardwired, interconnected alarms with battery backup so that activation of one triggers all alarms in the unit. Florida Statute 553.883 requires that any newly installed or replacement battery-powered smoke alarm use a non-removable, non-replaceable 10-year sealed lithium battery. One- and two-family dwellings undergoing repairs or Level 1 alterations may use 10-year sealed-battery alarms in lieu of full hardwiring retrofits. Listings must comply with UL 217. Landlords must ensure functioning alarms at the start of every tenancy.
Missing or inoperable smoke alarms can trigger Hialeah Building Department permit holds, failed inspections, and code-enforcement citations. Tampering with an alarm in a rental unit may expose landlords to civil liability after a fire. Confirm fine schedule with Hialeah Code Compliance at (305) 883-5820.
