NY Executive Law 378(5) requires smoke and CO detectors in all residential occupancies. Since April 1, 2019, all replacement smoke alarms must be 10-year sealed battery or hardwired units (Amanda Law).
Westchester follows NY Executive Law Sec 378(5) and the NY Uniform Fire Prevention and Building Code (19 NYCRR Part 1225). Smoke alarms required on every story, inside each sleeping room, and outside each sleeping area. NY General Business Law Sec 399-ccc (Amanda Law, effective April 1, 2019) requires that all newly sold or installed smoke alarms be either 10-year sealed non-removable battery units or hardwired. CO alarms required within 15 ft of each sleeping area under Amanda's Law (Public Health Law Sec 377). Rental dwellings must have detectors installed and maintained by the landlord; tenants must notify of malfunction. Enforcement via municipal building/fire inspectors; County fire marshal handles multi-jurisdictional cases.
Failure to install: up to $250 first offense under Exec Law. Tampering or removal by occupant: up to $500. Rental non-compliance may trigger certificate of occupancy revocation.
