Maryland law treats open carry of a handgun the same as concealed carry; both require a Wear and Carry Permit issued by the Maryland State Police. Long guns may generally be transported but not carried openly in a manner intended to threaten or alarm. The Public Safety Article preempts local rules attempting to authorize open carry without state authorization. Discharge ordinances enacted by counties remain valid. Carrying a loaded handgun on a public roadway, in a vehicle, or on the person without a permit is unlawful absent a statutory exception.
Unlawful wear, carry, or transport of a handgun is a misdemeanor with penalties of 30 days to 3 years imprisonment plus fines.
