The City of Phoenix regulates garage sales under Chapter 39 of the City Code (Property Maintenance) and related zoning rules. No permit is required for casual residential garage sales, but each residential property is limited to three garage sales per calendar year. Each sale may last no more than three consecutive days. Sales must occur during daylight hours only (sunrise to sunset), with no overnight setups or pre-dawn operation. Only personal used household goods belonging to the resident may be sold; commercial resale, new merchandise, or frequent re-stocked sales would constitute a business and require a Phoenix Privilege License.
Signage is regulated under Phoenix Sign Ordinance Section 705. Garage sale signs may be placed only on the seller's own private property and on private property where the owner has given written permission. Signs are prohibited on utility poles, traffic-control signs, street trees, medians, sidewalks, and any public right-of-way. The Streets Department actively removes illegally posted signs, especially on weekends. Signs must be removed within 24 hours after the sale ends.
Exceeding the three-sale annual cap or operating a de facto commercial resale is a civil code violation punishable by a fine of $50 for the first offense, $100 for the second within 12 months, and $250 for the third. Posting signs on public property carries a separate $50-per-sign fine plus removal cost. Repeated violations may escalate to criminal misdemeanor charges under Chapter 39.
